Attorney Brent Sumner Receives a Not Guilty Verdict for His Client in Weapons Case

Brent Sumner of The Sumner Law Group, LLC received a not guilty verdict for his client in the City of St. Louis. His client was charged with unlawful use of a weapon for carrying a concealed weapon without a permit. In Missouri, it is against the law to carry a concealed weapon without a concealed carry permit. The state of Missouri charged The Sumner Law Group's client with carrying a gun concealed in his backpack. Mr. Sumner took the case to trial and the jury came back with a not guilty verdict in twenty minutes.

Mr. Sumner argued that the gun was "not readily accessible," which is an element the state of Missouri must prove beyond a reasonable doubt in a concealed carry gun case. Mr. Sumner also argued for the jury instruction of emergency justification. The theory of the case presented by the defense was that the defendant was forced to conceal the gun in his bag because of an emergency situation that presented immediate harm to the defendant and others. This defense was successful with the jury.
